By accessing or using ABALink Network ("ABALink," "we," "us," or "our"), including its website, platform, and related services (collectively, the "Services"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, you may not use the Services.
These Terms apply to all users, including supervisors, supervisees, and visitors.
2. Purpose of the Platform
ABALink is a professional networking and organizational platform designed to facilitate connections, communication, and documentation related to supervision within the field of Applied Behavior Analysis (ABA).
ABALink does not provide clinical services, behavior-analytic treatment, supervision itself, or certification determinations.
3. Eligibility
To use ABALink, you must:
- Be at least 18 years old
- Provide accurate and truthful information
- Hold or be pursuing appropriate professional credentials if using supervision-related features
Users are solely responsible for ensuring their eligibility under applicable professional and regulatory standards.
4. User Accounts and Responsibilities
Users are responsible for:
- Maintaining the confidentiality of login credentials
- Ensuring the accuracy of information submitted
- All activity conducted under their account
ABALink is not responsible for unauthorized access resulting from user negligence.
5. Professional Responsibility Disclaimer
ABALink does not:
- Verify BACB credential status beyond user-provided information
- Guarantee compliance with BACB supervision requirements
- Replace independent professional judgment
Supervisors and supervisees remain fully responsible for:
- Ethical conduct
- Accurate documentation
- Compliance with BACB, state, and employer requirements
6. User Content
Users may upload or create content including logs, documents, messages, and profile information ("User Content").
By submitting User Content, you:
- Retain ownership of your content
- Grant ABALink a limited license to store, display, and process content solely to operate the platform
Users are prohibited from uploading content that is unlawful, misleading, defamatory, or violates professional or ethical standards.
7. Prohibited Uses
Users may not:
- Misrepresent credentials or supervision status
- Upload protected health information beyond intended platform use
- Use ABALink for fraudulent, deceptive, or unlawful purposes
- Interfere with platform security or functionality
Violation may result in suspension or termination.
8. Intellectual Property
All platform content, branding, design, and software are the property of ABALink Network and protected by intellectual property laws.
Users may not copy, distribute, or exploit platform materials without written permission.
9. Suspension and Termination
ABALink reserves the right to suspend or terminate accounts at its discretion for violations of these Terms, misuse of the platform, or legal or ethical concerns.
10. Limitation of Liability
To the fullest extent permitted by law, ABALink shall not be liable for:
- Certification outcomes
- Loss of supervision hours
- Professional, academic, or financial consequences
- Indirect, incidental, or consequential damages
Use of the platform is at the user's own risk.
11. Indemnification
Users agree to indemnify and hold harmless ABALink from claims, damages, or liabilities arising from:
- Use or misuse of the Services
- Violation of these Terms
- Breach of professional or legal obligations
12. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
13. Changes to Terms
ABALink may update these Terms at any time. Continued use of the Services after changes constitutes acceptance of the revised Terms.

HIPAA Disclaimer
Important Notice Regarding Health Information
ABALink Network is not a covered entity or business associate under the Health Insurance Portability and Accountability Act of 1996 (HIPAA).
ABALink is a professional supervision and networking platform, not an electronic health record (EHR) system or clinical service provider.
User Responsibility
Users are solely responsible for:
- Determining what information is uploaded or shared
- Ensuring compliance with HIPAA, state privacy laws, employer policies, and BACB ethical standards
- Avoiding the unnecessary inclusion of Protected Health Information (PHI)
ABALink does not require or request the upload of identifiable client health information.
Best Practice Guidance
When using ABALink, users are strongly encouraged to:
- De-identify client information whenever possible
- Avoid uploading names, dates of birth, addresses, or medical record numbers
- Follow BACB ethical guidelines related to confidentiality and data protection
No Clinical Oversight
ABALink does not:
- Monitor content for HIPAA compliance
- Assume responsibility for confidentiality breaches caused by user submissions
- Substitute for organizational compliance systems
All responsibility for compliance remains with the individual user and their employing organization.
